Recently, Brazil’s telecommunications regulator, Anatel, issued a warning to Elon Musk’s satellite internet company, Starlink. Anatel threatened sanctions against Starlink amidst a public feud with the billionaire entrepreneur over the country’s decision to block Musk’s social media platform, X. The conflict arose after Brazil’s supreme court mandated the suspension of X nationwide for failing to appoint a legal representative within the court’s deadline, as required by Brazilian law. This ruling was subsequently upheld by a panel of federal supreme court justices, leading Anatel to direct internet providers to block access to X in compliance with the court order.
Artur Coimbra, a commissioner at Anatel, disclosed that Starlink was the only company that openly declared its refusal to comply with the court decision. In an interview with CNN Brasil, Coimbra stated that Anatel is investigating the potential noncompliance of Starlink and other network operators. He emphasized that there are various sanctions that could be imposed on a company for failing to adhere to a court order, ranging from fines to the revocation of their operating license in Brazil. Despite requests for comment from Anatel and SpaceX, the company behind Starlink, both parties have remained silent on the matter.
The showdown between Musk and Brazil traces back to April when a representative from X revealed that court rulings compelled the company to block specific accounts. Musk promptly responded by announcing that the restrictions had been lifted and encouraged users to use virtual private networks (VPNs) if X were to be banned. Tensions escalated as Brazil geared up for municipal elections in October, with the country’s regulations requiring social networks to have a designated individual to handle government takedown notices related to political misinformation. X failed to comply with this requirement after withdrawing all of its personnel from Brazil the previous month, setting the stage for the current legal standoff.
Starlink Caught in the Crossfire
The targeting of Starlink by Anatel further heightens the clash between Musk and Brazil, particularly inflaming the billionaire’s dispute with Brazilian supreme court Justice Alexandre de Moraes, the architect of X’s ban. Starlink revealed that it was subjected to a freezing of its finances and restrictions on financial transactions in Brazil under Moraes’ orders. In response, X accused Moraes of intimidating its legal representative with imprisonment, alleging that the justice froze all of her bank accounts upon her resignation. Musk has not shied away from criticizing Moraes, labeling him as an “evil tyrant” and advocating for his incarceration. Moreover, Musk has condemned Brazil’s court ruling as an act of censorship.
